1. Overview

This website, www.wearodaline.com, is operated by Odaline (“Odaline”, “we”, “us” or “our”). These Terms of Service (“Terms”) apply to your use of our website and to any purchase you make from us. By visiting the site or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, which form part of them. If you do not agree, please do not use the site.

2. Eligibility

You must be at least the age of majority in your state of residence to place an order, or have the consent of a parent or guardian. You agree to provide accurate and complete information when you place an order and to keep it up to date.

3. Products

We do our best to show our products accurately, including colors, descriptions and fit notes. Colors can look different from screen to screen, and size charts and fit notes are guides based on measurements, so small variations are possible. Product availability can change without notice.

4. Prices and payment

All prices are shown in US dollars. Applicable sales tax and shipping are calculated at checkout. We may change prices at any time, but changes will not affect orders we have already confirmed. Payment is taken when you place your order and is processed securely by our payment providers. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, and we will let you know.

5. Orders

Your order is an offer to buy. We accept it when we ship your items and send you a shipping confirmation. We may refuse or cancel an order, or limit quantities, for example if an item is out of stock, if we suspect fraud or resale, or if there is an error in the product information. If we cancel an order after payment, we will refund you in full.

6. Promotions and discounts

Promotions and discount codes are subject to the terms shown with them, have no cash value, cannot be exchanged or transferred, and may be changed or ended at any time. Unless stated otherwise, only one discount code can be used per order. If you return part of an order that received a multi-buy saving, your refund reflects the price you actually paid for the returned item(s).

7. Shipping and delivery

We currently ship within the United States. Delivery times and costs are set out in our Shipping Policy. Delivery dates are estimates and are not guaranteed. Title and risk of loss pass to you when your order is delivered to the address you provided.

8. Returns and refunds

Returns and refunds are handled under our Refund Policy. Nothing in these Terms affects any rights you have under consumer protection laws that cannot be waived.

9. Intellectual property

All content on this site, including text, photography, graphics, logos and design, belongs to Odaline or its licensors and is protected by law. You may not copy, reproduce, distribute or use it for commercial purposes without our written permission.

10. Reviews and content you share

If you submit a review, comment, photo or other content, it must be honest, lawful and your own, and must reflect your genuine experience. You grant us a non-exclusive, royalty-free license to use, display and reproduce it in connection with our business. We may remove any content that breaks these Terms. We do not edit reviews to change their meaning.

11. Acceptable use

You agree not to use the site for any unlawful purpose; to interfere with its security or operation; to upload viruses or malicious code; to collect other people’s personal information; or to scrape, copy or resell our content or products without permission.

12. Third-party services

Our store runs on Shopify, and payments, shipping and other services are provided by third parties under their own terms. Links to third-party websites are provided for convenience only; we are not responsible for their content or practices.

13. Disclaimer

To the fullest extent permitted by law, the site and its content are provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded by law. We do not guarantee that the site will always be available, uninterrupted or error-free.

14. Limitation of liability

To the fullest extent permitted by law, Odaline will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or any product purchased from us. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states do not allow certain limitations, so some of these may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Odaline from any claims, losses or expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the site.

17. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in Wyoming, unless the law where you live gives you the right to bring a claim in your local courts.

18. Changes to these Terms

We may update these Terms from time to time. The version posted on this page applies to your use of the site and to orders placed after it is posted.

19. General

If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms, together with the policies referred to above, are the entire agreement between you and Odaline regarding the site and your purchases.
